Privacy Notice for California Residents
Effective Date: January 1, 2023
This Privacy Notice for California Residents ("Notice") supplements the information contained in our Privacy Policy, and applies to consumers who reside in the State of California ("consumers" or "you"). We adopt this Notice to comply with the California Consumer Privacy Act of 2018 ("CCPA") and any terms defined in the CCPA have the same meaning when used in this Notice.
Information We Collect, Use and Disclose
When you use the Driscoll's Sites, we collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information").

We use and disclose the categories of personal information that we collect for our business and commercial purposes in accordance with the HOW WE USE YOUR INFORMATION and WHEN WE SHARE YOUR INFORMATION sections of our Privacy Policy. We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated or incompatible purposes without providing you notice.
Please note that this Notice does not apply to workforce-related personal information collected from California-based employees, job applicants, contractors, or similar individuals (see CCPA Privacy Notice for Employees and Applicants).
Consumer Rights
Your Right to "Opt-Out"
We do not sell personal information to third parties or share personal information for purposes of cross-context behavioral advertising, so we do not offer an opt-out to the sale or sharing of personal information.
Your "Right to Know"
As a California resident, you have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months ("right to know"). Once we receive your request and confirm your identity, we will disclose to you the following: (i) the categories of personal information we collected about you and the categories of sources from which we collected such information; (ii) the specific pieces of personal information we collected about you (a "data portability request"); (iii) the business or commercial purpose for collecting personal information about you; and (iv) the categories of personal information about you that we disclosed and the categories of third parties with whom we disclosed such information in the preceding 12 months.
Your "Right to Delete"
You also have the right to request that we delete personal information collected from you subject to certain exceptions ("right to delete"). Once we review your request and confirm your identity, we will determine whether an exception allowing us to retain the information applies. We may deny your deletion request if retaining your information fits into one of the lawful exceptions. We will delete or deidentify personal information that is not subject to exceptions from our records and will direct our service providers to do the same.
Your "Right to Correct"
If we receive a verifiable request from you to correct inaccurate personal information ("right to correct") we will use commercially reasonable efforts to correct such personal information.
Non-Discrimination
You have the right to not be discriminated against in pricing and services because you exercise any of your rights under the CCPA. We will not discriminate against you if you exercise your CCPA rights. However, we may offer you certain incentives, such as coupons or other product discounts provided through Driscoll's reward and consumer advisory panel programs, permitted by the CCPA that can result in different prices. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in any incentive program requires your prior opt-in consent which you may revoke at any time.
How to Make a Request
To exercise the rights described above, please submit your request to us by either:
In order for us to process a CCPA request, you must submit proof of your identity to ensure the request is a verifiable consumer request. We may not be able to comply with your request if we cannot either confirm your identity or connect the information you submit in your request with personal information in our possession. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. If we cannot comply with your request, we will notify you in accordance with the CCPA.
Response Timing and Format
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us.. We will work to process all verified requests within 45 days. If we need an extension for up to an additional 45 days in order to process your request, we will provide you with an explanation for the delay.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Data Retention
Driscoll's will retain your personal information for as long as necessary to fulfill the purposes for which it was collected by us, including for the purposes of complying with our data retention policies and procedures and satisfying any legal, accounting, or reporting requirements, including applicable statute of limitations periods.
Other California Privacy Rights
California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Changes to this Notice
We will update this CCPA Notice from time to time in accordance with our Privacy Policy. Any changes will be posted on this page with an updated effective date. Your continued use of our Sites following the posting of changes constitutes your acceptance of such changes.
