Driscoll’s Berry Birthday Sweepstakes (”Sweepstakes”) 
2026 Official Rules

NO PURCHASE NECESSARY TO PARTICIPATE OR WIN. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. This Sweepstakes is open only to legal residents of the United States, the District of Columbia, and Canada who are at least 18 years old and have reached the age of majority in their state, province, or territory at the time of entry (19 in Alabama, Nebraska, British Columbia, Nova Scotia, New Brunswick, Yukon, Nunavut, Northwest Territories, and Newfoundland and Labrador). Do not enter if you are outside the United States or Canada or do not meet eligibility requirements.

  1. SWEEPSTAKES OVERVIEW: The Sweepstakes begins at 9:00:00 a.m. Pacific Time (“PT”) on January 1, 2026, and concludes at 11:59:59 p.m. PT on December 31, 2026 (the “Sweepstakes Period”). The promotion is divided into twelve (12) monthly drawing periods, each starting on the first day of the month and ending on the last day of the same month, from January through December 2026; each month/monthly drawing period has its own entry pool (each an “Entry Pool”). Eligible entrants can only enter the Sweepstakes before or during their birth month, after such date, they cannot gain entry into the Sweepstakes (for an example, see Section 3 below). For purposes of this Sweepstakes, the official timekeeping device will be Sponsor’s website server.
  2. ELIGIBILITY: Open to legal residents of the fifty (50) United States, the District of Columbia (including active-duty U.S. military members and their families stationed on U.S. bases), and Canada. Entrants must be at least 18 years of age and have reached the legal age of majority in their state, province, or territory of residence at the time of entry (19 in Alabama, Nebraska, British Columbia, Nova Scotia, New Brunswick, Yukon, Nunavut, Northwest Territories, and Newfoundland and Labrador). The following individuals may not participate or claim a prize: employees, officers, directors, and contractors of Driscoll’s, Inc. (“Sponsor”), its parent, subsidiaries, affiliates, and all agencies involved in the creation, administration, advertising, or fulfillment of this Sweepstakes, including Secure Digital Promotions LLC (“Administrator”) (collectively, “Sweepstakes Parties”), along with their immediate family members (defined as spouse, parent, child, sibling, grandparent, or step-relative) and anyone living in the same household (whether related or not) for at least three consecutive months during the twelve months before the Sweepstakes start date.
  3. TO ENTER THE SWEEPSTAKES: During the Sweepstakes Period, but before the conclusion of the entrant’s birth month, entrants can visit https://www.driscolls.com/Rewards-Birthday (“Website”) to complete the entry form with all requested information, including their birth month, and submit to receive one (1) entry into the drawing for the Entry Pool that corresponds to the entrant’s birth month. Entries will only be accepted if the birth month selected has yet to occur or has yet to be complete. If an entrant submits an entry after the last day of their birth month, they will not receive any entry into the Sweepstakes and their entry will not be included in any Entry Pool. Just by way of example, if Jane was born on March 21, she can enter the Sweepstakes between January 1, 2026 and March 31, 2026 and any entry attempt by Jane on or after April 1, 2026 will be void.  Entrants may register at any time, however, their entry is only eligible for the Entry Pool that corresponds with their birth month.
  4. SWEEPSTAKES ENTRY REQUIREMENTS/RESTRICTIONS: Limit one (1) entry per person per email address during the Sweepstakes Period. Automated means of participation are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple email accounts, nor may entrants use any other device or artifice to enter multiple times above the stated limit or as multiple entrants. Any entrant who attempts to enter using any device or artifice to enter above the stated limit may be disqualified and forfeit any prize won, in the Sponsor’s sole discretion. Proof of submission is not proof of receipt by Sponsor. In the event of a dispute as to who submitted the entry, the natural person associated with the email account used for entry will be considered the entrant, but only if that person is otherwise eligible to enter the Sweepstakes and is the copyright owner of the entry. By participating, entrants agree to abide by and be bound by these Official Rules and the Sponsor’s decisions, which are final and binding.
  5. PRIVACY POLICY: Information collected by Sponsor and its agencies in connection with the Sweepstakes may be used by Sponsor and its agencies in accordance with the online Privacy Policy at https://www.driscolls.com/privacy-and-terms.
  6. SWEEPSTAKES WINNERS: One (1) potential Grand Prize winner will be chosen at random for each of the twelve (12) Entry Pools (one (1) per Entry Pool, as outlined below in the drawing schedule) from amongst all eligible entries submitted for that specific Entry Pool. Entries do not carry over into later Entry Pools. The odds of winning a Grand Prize are determined by the total number of eligible entries received for each applicable Entry Pool.

  7. PRIZE QUANTITIES AND VALUE:  Twelve (12) verified Grand Prize Winners will each receive one Grand Prize: a $100.00 USD / $140 CAD pre-paid gift card.
    Prepaid cards are subject to the terms, conditions, and restrictions imposed by the issuing company. Visa and the Visa logo are registered trademarks of Visa U.S.A. Inc. Visa U.S.A. Inc. does not sponsor and is not affiliated with this Sweepstakes.
  8. PRIZE RESTRICTIONS: Limit one (1) prize per person during the entire Sweepstakes. Each Grand Prize winner is solely responsible for all applicable federal, state, provincial/territorial, and local taxes, as well as any other costs, fees, or expenses associated with the prize. The prize is non-transferable and may not be exchanged, except that the Sponsor reserves the right, at its sole discretion, to substitute the prize with one of equal or greater value if the original prize becomes unavailable.
  9. WINNER NOTIFICATION AND PRIZE CLAIM:  Each potential winner is subject to verification, including confirmation of age and address. Each potential winner will be notified by email at the email address used for entry and must respond within seven (7) business days with the requested prize claim details. Failure to respond within this period may result in forfeiture of the prize. Verified prizes will be shipped to the mailing address provided within approximately 2-4 weeks of verification. A potential winner may be disqualified and their prize may be forfeited if: (1) the notification or prize is unclaimed or returned as undeliverable; (2) the notification is not received in time for any reason, including being filtered as spam; (3) required prize-related documents are not returned within the specified timeframe; (4) a potential winner declines the prize, is ineligible, or fails to comply with these Official Rules; (5) a potential winner refuses to accept the prize as awarded. Sponsor is not responsible for any changes to entrants’ mailing addresses, email addresses, or telephone numbers.
    Canadian Grand Prize Winner: If a potential Grand Prize winner resides in Canada, they must correctly answer a time-limited skill-testing question without any form of assistance to be confirmed as the winner. Failure to provide the correct answer will result in disqualification, and an alternate winner may be selected, if time allows.
  10. GENERAL CONDITIONS: Any attempt to deliberately damage a website or disrupt the lawful operation of this Sweepstakes is a violation of criminal and civil law. If such an attempt is made, the Sponsor reserves the right to pursue damages and other remedies to the fullest extent permitted by law, including criminal prosecution. If the Sweepstakes cannot run as intended due to causes such as computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or other issues that compromise the administration, security, fairness, or proper conduct of the Sweepstakes, the Sponsor, in its sole discretion, may disqualify any person responsible and cancel, modify, or terminate the Sweepstakes. In addition, if events beyond the Sponsor’s reasonable control (“Force Majeure” events) make the Sweepstakes impracticable, such as natural disasters, pandemics, extreme weather, strikes, equipment failures, terrorism, war, government actions, or similar occurrences, the Sponsor reserves the right to shorten, suspend, cancel, or terminate the Sweepstakes without further obligation. In such cases, prizes for any drawings already completed will be awarded as described, and no additional drawings will be conducted. If an entry is lost, deleted, or destroyed in error, the entrant’s sole remedy will be to receive another entry into the Sweepstakes. The Sponsor may update or clarify these Official Rules online from time to time, provided such changes do not materially alter the Sweepstakes terms and conditions.
  11. LIMITATIONS OF LIABILITY AND RELEASE: The Sponsor and Sweepstakes Parties assume no liability for any issues arising from an entrant’s participation, attempted participation, or downloading of materials related to this Sweepstakes. Without limitation, they are not responsible for technical errors or malfunctions of any kind, including hardware or software failures; problems with computers, telephones, cables, satellites, networks, electronics, wireless connections, or Internet service providers; server or host issues; corrupted or misdirected data transmissions; failed, delayed, lost, or intercepted emails; partial or total inaccessibility of the Website; Internet or Website traffic congestion; or unauthorized human or automated interference such as tampering, hacking, theft, viruses, bugs, or worms. Sponsor is not responsible for typographical errors in prize announcements, these Official Rules, or inaccurate information posted on the Website. Website use is at the entrant’s own risk. Neither the Sponsor nor the Sweepstakes Parties are responsible for personal injury, property damage, or other losses of any kind to an entrant’s or any other person’s computer or device resulting from entry, Website use, or downloads. By entering, each entrant agrees to release and hold harmless the Sponsor and Sweepstakes Parties from any claims, damages, or losses connected to participation in the Sweepstakes or the receipt, possession, use, or misuse of a prize.
  12. BINDING ARBITRATION: Any controversy or claim arising out of or relating to the Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes outlined in the Comprehensive Arbitration Rules and Procedures of JAMS (“JAMS Rules and Procedures”) then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply California state law consistent with the Federal Arbitration Act and applicable statutes of limitations and shall honor claims of privilege recognized at law. If the claimant can demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the claimant’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive. If any part of this arbitration provision is deemed to be invalid, unenforceable, or illegal (other than that claim will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS. If, however, the portion that is deemed invalid, unenforceable, or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
    BY PARTICIPATING IN THIS SWEEPSTAKES, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT'S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.
  13. PUBLICITY: Except in Tennessee or where restricted by law, acceptance of a prize constitutes the winner’s consent for the Sponsor and its authorized agents to use the winner’s name, city and state/province/territory of residence, photograph, voice, and/or likeness for advertising or publicity purposes in any media now known or developed in the future, without time or geographic limitation, additional notice, or further compensation. In addition, the winner’s information may be included on a publicly available winners’ list.
  14. GOVERNING LAW & JURISDICTION: To the maximum extent allowed by law, all matters regarding the construction, validity, interpretation, and enforceability of these Official Rules, as well as your rights and obligations or those of the Sponsor in connection with the Sweepstakes, will be governed by the laws of the State of California, U.S.A., without regard to conflict of law principles. Any disputes or proceedings not subject to arbitration under Section 12 of these Official Rules, or related to enforcement of an arbitration award, must be brought exclusively in the federal, state, or local courts located in Santa Cruz County, California. The Sponsor’s decision not to enforce a provision of these Official Rules will not be considered a waiver of that provision or any other. If a provision is found invalid or unenforceable, it will be removed, and all remaining provisions will continue to apply.
